INSTANT PAYMENT SERVICE TERMS – USER TERMS
Subject to our approval, you may elect to receive any payments from us directly to your existing bank account through the instant payment service (the "Instant Payment Service").
The Instant Payment Service is a payment disbursement service provided by IQVIA in conjunction with Florida Capital Bank, N.A. ("Bank"), which provides certain electronic fund transfer services in support of the Instant Payment Service.
To use the Instant Payment Service, you must provide us with certain personal information, including, without limitation, your name and payment card information (collectively, "User Information"). Use of the Instant Payment Service is subject to our Privacy Policy, available at https://www.iqvia.com/about-us/privacy. You represent and warrant that all User Information you provide us from time to time for purposes of accessing the Instant Payment Service is truthful, accurate, current, and complete. You agree to promptly notify us of changes to any User Information.
By using the Instant Payment Service, you further represent and warrant to us that: (a) you are at least 18 years of age (or older if you reside in a state where the majority age is older); (b) you are a U.S. citizen or legal alien residing in the United States; (c) you received a copy of these Terms and our Privacy Policy and agree to be bound by and to comply with their terms.
You may not use the Instant Payment Service for any illegal transactions. We may temporarily suspend your access to the Instant Payment Service and attempt to contact you if we notice transactions or activity that are unusual or appear suspicious.
To the extent permitted by applicable law, we may cancel or suspend your access to the Instant Payment Service immediately, for any reason, and without notice to you. You may cancel or withdraw your election to receive payments from us via the Instant Payment Service at any time by notifying Customer Service at (800) 471-0186.
EXCEPT AS REQUIRED BY LAW, NEITHER IQVIA NOR BANK MAKES ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND TO YOU, WHETHER EXPRESS OR IMPLIED, REGARDING THE INSTANT PAYMENT SERVICE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL IQVIA OR BANK BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER OR NOT THE POSSIBILITY OF SUCH DAMAGES HAS BEEN DISCLOSED IN ADVANCE OR THAT COULD HAVE BEEN REASONABLY FORESEEN, REGARDLESS OF THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT OR OTHERWISE) UPON WHICH THE CLAIM IS BASED, AND NOTWITHSTANDING THE FAILURE OF ANY AGREED OR OTHER REMEDY OF ITS ESSENTIAL PURPOSE.
